12 June 1975: The Judge Threw Out Most Charges Against Indira Gandhi, Upheld Two, and Parliament Rewrote the Law So They No Longer Counted
What the Allahabad High Court actually found in Raj Narain's election petition, issue by issue, and what it rejected. How a conditional stay on 24 June became an Emergency on 25 June, how Parliament changed the election law and the Constitution while her appeal waited, and why the Supreme Court struck down the clause that validated her election and still upheld it. The point of view
On 12 June 1975 a High Court judge declared the Prime Minister's election void and barred her from elected office for six years. Most Indians remember the verdict and the Emergency that followed thirteen days later. Few know what the judge actually found. He rejected bribery, the cow-and-calf charge, free transport of voters, the Air Force planes and the spending charge. He upheld two findings, both about government servants helping her campaign. One side calls those trivial; the other calls her a cheat. The court record supports neither cleanly. This file tests nine claims against the judgments, the statutes and Parliament's own record.
